State Senators Paula Hicks-Hudson and Theresa Gavarone have introduced Senate Bill 325, a new piece of legislation aimed at reforming Ohio's family court system to prioritize the best interests of children.
Hicks-Hudson, a Democrat from Toledo, emphasized the importance of language in family law: "As an attorney whose primary practice is in family law, this bill changes the way parents and custodians will be viewed in the law," she said. She noted that the bill is a collaborative effort involving the court, practitioners, and interested parties.
Gavarone, a Republican from Bowling Green, echoed these sentiments: "As an experienced family law attorney, I know these cases can be complex, but the best interest of the kids involved is always paramount." She stated that the legislation would provide courts with more tools to help families achieve ideal outcomes for children.
Senate Bill 325 seeks to modernize parenting plans by focusing on child-centered approaches. It outlines shared responsibilities for parents or legal custodians to foster meaningful relationships with their children when it aligns with their best interests. The bill also clarifies what constitutes a child's best interest by including factors such as safety and past parental abilities to meet daily needs.
The development of this legislation stems from decades of work initiated by various stakeholders including the Supreme Court of Ohio and experts in family law. Senate Bill 325 is currently awaiting referral to a committee for further consideration.
